Course abstract

Students acquire an in-depth knowledge of family legal relations between spouses, legal aspects of mutual relations of parents and children as well as property relations of married couples. Students get the knowledge of basic principles of hereditary rights and types of inheritance in Latvia as well as distribution of inheritance among inheritors to be able to define and critically analyse family and inheritance problems. Students acquire an in-depth knowledge of family legal relations between spouses, legal aspects of mutual relations of parents and children as well as property relations of married couples. Students get the knowledge of basic principles of hereditary rights and types of inheritance in Latvia as well as distribution of inheritance among inheritors to be able to define and critically analyse family and inheritance problems.

Learning outcomes and their assessment

KNOWLEDGE
Students will be able to: demonstrate the understanding of substance of family and inheritance law and its role in the legal system of Latvia. (Test)
SKILLS
Assess the barriers to entering into marriage stipulated by law. (Test) Theoretically distribute inheritance in accordance with law and the testament. (Legal case) Present the results of the independent work done. (Independent work)
COMPETENCE
Independently define and critically analyse problems in relation to the legal framework on family and inheritance. (Independent work). Come up with potential amendments to the legal framework on family and inheritance. (Discussion)

1. Concluding a marriage (2 h lectures, 1 h practical)
2. Termination of the marriage (2 h lectures, 1 h practical)
3. Legal and contractual relations of spouses (3 h lectures, 1 h practical)
4. Legal aspects of mutual rights and obligations of parents and children (3 h lectures, 1 h practical)
5. Custody (2 h lectures, 1 h practical)
6. Guardianship and trusteeship (3 h lectures, 1 h practical)
7. General rules of inheritance law (2 h lectures)
8. Legal inheritance (2 h lectures, 1 h practical)
9. Testamentary inheritance (3 h lectures, 1 h practical)
10. Contractual inheritance (1 h lectures)
11. Test (1 h)

Requirements for awarding credit points

1. The student must pass the tests on conclusion of a marriage and termination of the marriage and complete the independent work

Description of the organization and tasks of students’ independent work

1. Independent work. Legal case solving about guardianship and trusteeship, with emphasis on differences in the terms.
2. Independent work. Preparation for a discussion on the mutual rights and responsibilities of parents and children.
3. Independent work. Legal case solving about contractual and testamentary inheritance and the presentation of the results during practicals.
4. Independent work. Development of recommendations on amendments to the legal framework for family and inheritance law.

Criteria for Evaluating Learning Outcomes

The final cumulative mark depends on the marks of a test, a multichoice test, a legal case study and a piece of independent work.
The weights of assessments: the test – 20%, the multichoice test and the legal case – 30%, the independent work – 30%, while the student’s activity during practicals – 20%.
