Course abstract

Within study subject “Land Rights II” students acquire basic principles of land ownership rights system, its goals and tasks, improve their knowledge in various legal aspects of land ownership rights. They improve their form of expression and writing style, drawing conclusions on topical issues.
Within study sub-subject “Real property formation” students acquire modern, really functioning formation system in Latvia, its objectives and tasks. In frame of land policy competences in real property formation issues is very necessary for legal arrangement of real property.

Learning outcomes and their assessment

- knows the alienation of property rights for needs of the state and society; legal regulation of shared property, land under forests, waters, subsoil and specially protected nature territories and other special needs, as well as legal regulation of administrative process (Test 1)
- can independently using portal www.likumi.lv find necessary regulation of the regulatory enactment for specific situation (Test 1; 2 and 3)
- Is able to in cooperation with supervisor of study course to perform the analysis and solution of the obtained results (Test 1; 2 and 3)
Within study sub-subject “Real property formation” students:
- knows and critical understand general issues of formation of real property, as well as on formation of land parcels, buildings and sets of premises, and composition of real properties; (Test 1)
- can without assistance perform functions of real property formation and use methods of real property formation; (Test 1)

- is able to in collaboration with supervisor of study course to manage processing and evaluation of achieved results. (Test 1)

Full-time studies:
Land rights II:
1. Legal regulation of land property formation and its dynamics (2h)
2. Options for solution of division and amalgamation of land not registered in Land Register (Land Book) (1h).
3. Expropriation of property for the needs of the state and society (4h).
Test 1: Land properties and their expropriation for needs of the state and society
4. Peculiarities of formation of divided property and conditions of its cancellation (2h).
5. Legal regulation of forests, waters, subsoil and specially protected nature territories and other land of special needs (4h).
Test 2: Divided property; restrictions in forests, waters, subsoil, specially protected areas.
6. Judicial system in Latvia (1h).
7. Basic rules of Administrative process in the institution (2h).

1. Property reform in Latvia (1h)
2. General requirements in real property formation (1h)
3. Formation of land parcels and composition of land properties (1h)
4. Formation of buildings and composition of building properties (1h)
5. Formation of groups of premises and composition of residential properties (1h)
6. Common properties, their division into real parts (1h)
7. Rights and obligations of persons involved in the formation process (1h)
8. Documents created during formation process and their arrangement in files. (1h)
Test 1

Part-time studies:

All topics specified for full-time studies are implemented, but the number of contact hours is 1/2 of the specified number of hours

Requirements for awarding credit points

1. Successfully learned the substance of lectures, positive results of laboratory and independent work
2. Attendance of at least 85% of classes
3. Assessment of exam consist of:
- positive evaluation of the answers on exam questions

- positive evaluation of tests, laboratory and independent work

Description of the organization and tasks of students’ independent work

Real property formation:
Throughout the semester - studies of scientific and study literature (monographs, scientific articles and their collections, conferences and seminars materials, specialized scientific periodicals) specified by the lecturer and required for the acquisition of professional competence in the course.
Before each lesson independent work - 3 hours.
The results of independent work are written in handwriting, submitted in manual (paper) form, volume - at least 5 pages.
1. Establishment of land properties in the process of land reform. Establishment of building properties. Establishment of residential properties. Documents certifying the legal acquisition of real property. (3 hours)
2. Tasks and activities of formation of cadastral objects. Formation of real property objects (land parcels, buildings and groups of premises). Composition of real property. (3 hours)
3. Division and amalgamation of land parcels. Adding a part of a land unit to an adjacent land parcel. Establishment of new land parcel, including a land parcel owned on the basis of joint ownership. (3 hours)
4. Establishment of new buildings, including buildings owned on the basis of joint ownership rights. Division and amalgamation of buildings. Determination of the fact of the absence of building. (3 hours)
5. Establishment of new group of premises. Division and amalgamation of groups of premises. (3 hours)
6. Division of a jointly owned land parcel, building, group of premises into real parts. (4.5 hours)
7. Obligations and rights of owners and performers of formation works. Obligations and rights of local governments and other state institutions in the formation of real property. (3 hours)

8. Legal aspects of real property formation and practice in EU countries. (3 hours)

Criteria for Evaluating Learning Outcomes

The results of studies in the10-point system are evaluated according to the following criteria:
1. Assessment of exam depends on cumulative assessment of results of student's answers to exam questions, results of tests, laboratory and independent work and attendance of classes.
2. Successful mark in tests is obtained if 50% of questions are answered correctly.
3. Evaluation of independent work depends on the volume and quality of the arguments presented in the discussion.
4. Successful mark is obtained if:
- according to the student's answers to exam questions, it is assessed whether they demonstrate knowledge and critical understanding of general settings in real property formation, as well as the formation of land units, buildings and groups of premises, and real property formation, have they acquired the skills independently to perform real property formation activities and apply real property formation methodology, and are able to process and evaluate the obtained results
- have been obtained positive assessment of the results of exam questions, tests, laboratory and independent work

- at least 85% of classes have been attended.
