Course abstract

Students gain knowledge on the basics of state and law theory and get an insight in leading branches of law – constitutional , administrative, civil, conceptual bases of Forest Legislation. International conventions and agreements regulations of the Europe Union, Forest Legislation of Latvia as a instrument of National Forest Policy, forest Legislation development (Forest Act, restrictions), forest as private property, special requirements.

Learning outcomes and their assessment

Knows the essence of legal science, the evolution of legal ideas, the functions of law and the role of law today. An understanding of the leading branches of law of the Latvian legal system has been formed - constitutional law, administrative law and civil law, of the most important legal acts in the forest sector, their use. test • Is able to orientate freely in the Latvian legal system, use legal sources, identify legal problems and facts important for solving these problems, develop legal documents, use them in resolving conflict situations in matters related to forest management and use. Test • Able to analyze and evaluate legal phenomena and processes in various branches of law and forest management. Practical work

1 The concept and essence of state and law. State and administrative law. Work rights. Employment contract (lecture 1 h, practice 1 h)
2 Civil law. Civil law, its role in society. (lecture 1 h, pract. 1 h)
3 The concept of inheritance law, the most important types. Aspects of family law (lecture 1 h, pract. 1 h)
4 EU guidelines on forest management issues - binding directives, regulations, regulations (lecture 1 h, pract. 1 h)
5 The concept of property rights, types of acquisition, meaning (lecture 1 h, pract. 1 h)
6 International requirements - treaties, conventions and agreements that are binding in forest management and use (lecture 1 h, pract. 1 h)
7 Forest policy, its relation to forest legislation. (lecture 1 h, pract. 1 h)
8 International obligations and European Union regulations The concept of law. Legislative process (lecture 1 h, practice 1 h)
9 State Forest Service Law - task, structure, duties and rights of the service.
10 Forest law, purpose, object and subject of the law (lecture 1 h, pract. 1 h)
11 The right of persons to reside in the forest and the use of non-timber forest values. (lecture 1 h, pract. 1 h).
12 Use of forest for timber production - conditions for starting tree felling (lecture 1 h, pract. 1 h) 13 Reforestation and afforestation. Forest protection (lecture 1 h, practice 1 h)
14 Conditions for submitting and servicing information about the forest (lecture 1 h, pract. 1 h)
15 Nature protection in the forest. Transformation of forest land (lecture 1 h, pract. 1 h)
16 Forest violations, responsibility for them. Compensation for losses to the state and the forest owner - legal manager (lecture 1 h, pract. 1 h)

Requirements for awarding credit points

Two tests must be written and credited; report developed and presented in the group

Independent literature studies and prepared report.
